We are an internet trading name for the online packaging business of DS Smith Packaging ltd, a company registered in England and Wales under company number 630681 and with its registered office at Level 3, 1 Paddington Square, London W2 1DL, United Kingdom(“we/our/us”). Our principal place of business for the online packaging service is Milton Keynes.

These Web Site Terms & Conditions (“Terms”) apply to all Goods and Services between you, the User of this Web Site and us, the owner of this Web Site. We strongly recommend that you read these Terms carefully and make sure that you understand them before ordering any Goods or using any of the Services from us. If you do not agree to be bound by these Terms, you should stop using this Web Site immediately.

    In these Terms the words starting with capital letters shall have the following meanings:

    “Carrier” means any third party responsible for transporting purchased Goods from our Premises to customers;

    "Consumer" means an individual acting for purposes that are wholly or mainly outside that individual’s trade, business, craft or profession;

    “Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

    “Goods” means any products that we advertise and/or make available for sale through this Web Site;

    “Purchase Information” means collectively any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form;

    “System” means any online communications infrastructure that we make available through this Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards and email links;

  3. Use of this Web Site and Accounts
    1. Persons under the age of 18 should use this Web Site only with the supervision of an adult. Payment Information must be provided by or with the permission of an adult.
    2. In order to purchase Goods on this Web Site you may create an Account which will contain certain personal details which may vary based upon your use of this Web Site. By continuing to use this Web Site you agree that:
      1. all information you submit is accurate and truthful;
      2. you have permission to submit Payment Information where permission may be required; and
      3. you will keep this information accurate and up-to-date. Your creation of an Account is further confirmation of your agreement to the matters at Clauses 3.2.1 – 3.2.3 above.
    3. It is recommended that you do not share your Account details, particularly your username and password. We do not accept any liability for losses or damages incurred as a result of your Account details being shared by you. If you have reason to believe that your Account details have been obtained by another without consent, you should contact us immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled up until they are dispatched. In the event that an unauthorised purchase is dispatched prior to you notifying us of the unauthorised nature of the purchase, we do not accept any liability or responsibility and you should make contact with the Carrier detailed in the Purchase Information.
    5. When choosing your username you are required to adhere to the terms set out in Clause 6 below. Any failure to do so could result in the suspension and/or deletion of your Account.
  4. Orders and our contract with you
    1. Our acceptance of your order for Goods will take place when we email you to confirm your order, indicating that your order has been fulfilled and is on its way to you, at which point a contract will come into existence between you and us. If we confirm your order, we will charge you for the Goods. No part of this Web Site is intended to constitute a contractual offer capable of acceptance by you.
    2. If we are unable to accept your order, we will inform you of this by email and will not charge you for the Goods. This might be because the Goods are out of stock, because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the Goods.
    3. You will be responsible for payment of any import duties and taxes for deliveries outside of the United Kingdom. Please contact your local customs office for further information before placing your order.
    4. You must comply with all applicable laws and regulations of the country for which the Goods are destined. We will not be liable or responsible if you break any such law.
  5. Goods, pricing and availability
    1. You will be required to select the required quantity of the Goods that you are purchasing.
    2. We provide stock indications on this Web Site as a guide only. These indications may not take into account sales that have taken place during your visit to this Web Site.
    3. Sample orders are limited to one unit per sku per customer. If you require more than one sample please contact us by telephone or email as per our contact details.
    4. All pricing information on this Web Site is correct at the time of going online. The price payable by you shall be the price quoted on the Web Site at the time of placing the relevant order. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary. All pricing information is reviewed and updated regularly.
    5. In the event that prices are changed during the period between your order being placed for Goods and our processing that order and taking payment, we will contact you prior to your order being processed with details of the new price. You may cancel your order if the new price is not acceptable.
    6. We will invoice you once we have received the confirmation from our gateway that the transaction has been completed.
    7. Dimensions given in the webshop and on bespoke orders can vary by up to 3 mm.
    8. When producing bespoke boxes, you have no right to reject the supply if it varies from the specification and that variation is not material to their use or functionality or is a variation in the quantity which is within 10% of the amount ordered. Printed price and plates are subjected to the sight of the artwork and the tooling which is charged at extra unless otherwise stated, and will be charged separately unless otherwise agreed. Any tooling purchased by the customer will be stored for the 18 months following the date of the last production run. After 18 months of inactivity, DS Smith reserves the right to dispose of the tooling unless the customer requests delivery of the obsolete tooling.
  6. Use of this Web Site and Services
    1. When using the Services and any System on this Web Site you should do so in accordance with the following rules:
      1. you must not use obscene or vulgar language;
      2. you must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
      3. you must not submit Content that is intended to promote or incite violence;
      4. it is advised that submissions are made using the English language as we may be unable to respond to enquiries submitted in any other languages;

  11. Delivery
    1. We will deliver the Goods to you via our own vehicles or third party transport at the cost stated in our order confirmation. Cost of delivery may be included dependent upon your location. We reserve the right to not accept the order dependent upon your location and accessibility of the delivery location for our vehicles.
    2. The estimated timeframe for delivery of the Goods within the United Kingdom is up to 7 Working Days.
    3. Customers will receive a confirmation email to the address provided confirming the delivery date. If you request any changes to your delivery date, this must be notified to us by e-mail or telephone (details provided above) with a minimum of 24 hours’ notice before the delivery date in your confirmation email to avoid a re-delivery charge.
    4. Customers may be charged a re-delivery fee if the vehicle is unable to access the delivery address.
    5. We shall not be liable for any loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.
    6. All risk in the Goods shall pass to the Customer upon delivery.
    7. The costs of delivery (where applicable) will be given at the point of placing the order.
    8. Delivery of the Goods shall be made by us to the address you have indicated on the Order, or by you collecting the Goods at our premises at any time after we have notified that the Goods are ready for collection.
    9. If you fail to take delivery of the Goods then without limiting any other right or remedy available to us, we may store the Goods until actual delivery and charge you for the reasonable costs (including insurance) of storage.
    10. A signature indicating safe receipt of the Goods will be required on delivery or collection.

  12. Faulty goods
    1. We are under a legal duty to supply products that are in conformity with this contract.
    2. We aim to always provide high quality Goods that are fault free and undamaged. However, on occasion Goods may need to be returned to us. If any Goods you purchase are damaged, faulty or do not match their description when delivered to you we may, at our sole discretion, offer a repair, exchange or refund, as appropriate, in accordance with your legal rights.

If you believe an item is faulty, damaged or not as described you should contact us within 5 Working Days and, unless we agree otherwise, arrange for the return of the item to the following address: Andersen Gate, Milton Keynes MK4 4AE, United Kingdom during a Working Day, by a mutually agreeable method.

  13. Order return
    1. Where you return Goods to us for reasons other than such Goods being defective or faulty as set out in clause 12, we will only accept unwanted products at our sole discretion within 30 days of delivery. The Goods must be unopened, in a saleable condition and will be subject to a restocking fee of £20.00.
    2. It is your responsibility to ensure that any Goods that are returned to us are safely and securely packaged to ensure that they are returned undamaged and suitable for re-sale. Goods are not sold on a trial or return basis.
    3. Our 30 days return policy and the right of withdrawal shall not apply to bespoke or customised goods made or produced based on customer’s specifications.
  14. Customer approvals
    1. Where you supply us with artwork, prints, designs, logos, instructions or other information to be printed on the goods, you shall be solely responsible for their accuracy and your hold proper rights to print and use them.
    2. Where we supply proofs, printing details, artwork or other specimens for you to approve as complying with your order you must do so promptly and in writing. We are not responsible for any delay you cause. Our obligation is to produce and/or print the goods, you shall be solely responsible for their accuracy.

  15. Coffee Cup Drop Box
    1. Where your order from the Web Site includes the DS Smith Coffee Cup Drop Box (the “Drop Box”), your use of the Drop Box will be subject to the following conditions:
      1. You are responsible for following the instructions printed on the Drop Box;
      2. Once the Drop Box is ready for collection, you are responsible for contacting DS Smith using the number that is notified to you as per the instructions on the Drop Box (the “Courier”) to organise collection of the Drop Box; and
      3. The Courier is not obliged to collect the Drop Box and may leave the Drop Box at your premises if the Drop Box is contaminated (which may include, but is not limited to, the presence of food waste, coffee waste, coffee lids or other non-coffee cup related items).
  16. Service availability
    1. Our products are only intended for use by customers resident in the United Kingdom and the Republic of Ireland. We do not accept orders from outside of the United Kingdom and the Republic of Ireland.
  17. Availability
    1. We shall endeavour to hold sufficient stock to meet all Orders. However, if there is insufficient stock to supply or deliver the Goods already paid for by you, we shall, at our discretion, supply or deliver a substituted product or refund the price paid for the Goods as soon as possible and in any event within 30 days or, where you are an account customer, we may, at our absolute discretion, raise a credit to offset the amount invoiced to you.
  18. Credit card security
    1. All Payment Information provided by you when placing an Order is handled by a third party online payment processing provider that is compliant with all relevant security standards, including the Payment Card Industry Data Security Standard (PCI DSS).
  19. Termination and cancellation
    1. Either you or we may terminate your Account. If we terminate your Account, you will be notified by email and an explanation for the termination will be provided. In any event, we reserve the right to terminate without giving reasons.
    2. If we terminate your Account, any current or pending purchases on your Account will be cancelled and will not be dispatched.
    3. We reserve the right to cancel purchases without stating reasons, for any reason prior to processing payment and arranging dispatch.
    4. If purchases are cancelled for any reason prior to dispatch you will be refunded any monies paid in relation to those purchases.
    5. If you terminate your Account, any non-dispatched purchases will be cancelled and you will be refunded any monies paid in relation to those purchases.

  27. Law and where you may bring legal proceedings

    These Terms and the relationship between you and us shall be governed by English law and you may bring legal proceedings in respect of the Goods and/or Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts
